Welcome to Happy Skin Baby ("we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of happyskinbaby.com (the "Site") and any orders you place with us. By using the Site or placing an order, you agree to these Terms. Questions? Reach us at [hello@happyskinbaby.com].

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) to place an order. If you're under 18, an adult must complete the purchase on your behalf.

2. Products & Availability

Our products are designed as sleepwear and apparel for infants and young children. We do our best to display colors, patterns, and details accurately, but actual items may vary slightly due to monitor settings, fabric batches, or production updates. We may discontinue, modify, or limit availability of any product at any time.

3. Pre-Orders

At launch, items on the Site are sold on a pre-order basis. When you place a pre-order:

  • Your payment method is charged at checkout (unless we explicitly tell you otherwise on the product page).
  • Estimated ship windows are shown at checkout (typically 4–6 weeks from order date). Actual ship times may vary based on production.
  • We'll email you with tracking information once your order leaves our warehouse.
  • If we cannot fulfill your pre-order within a reasonable additional time after the estimated window, we'll contact you and offer a full refund.

4. Pricing & Payment

All prices are listed in U.S. dollars unless otherwise noted, and exclude applicable taxes and shipping. We accept the payment methods displayed at checkout. By providing payment information, you authorize us to charge the total amount of your order, including taxes and shipping, to your selected method.

We reserve the right to correct pricing errors. If a product is listed at an obviously incorrect price, we may cancel the order and notify you before charging.

5. Shipping & Delivery

See our Shipping Policy for delivery destinations, times, and rates. Title and risk of loss pass to you upon delivery of the package to the carrier. International orders may be subject to import duties or taxes that are your responsibility.

6. Returns & Refunds

See our Refund Policy for details on returns, exchanges, and refund timelines. We generally accept returns of unworn, unwashed items with original tags within [30] days of delivery.

7. Children's Product Safety

Happy Skin Baby garments are designed as sleepwear and apparel for infants and toddlers. To use safely:

  • Follow size and age guidance on the product page.
  • Inspect garments before each use for loose threads, missing snaps, or other defects.
  • Discontinue use immediately if a product becomes damaged.
  • Use only as intended — sleepwear is not a substitute for adult supervision.

Our snug-fitting sleepwear is designed to meet U.S. flammability standards under 16 CFR Part 1615/1616 for snug-fit pajamas. Garments labeled for "snug fit" must fit closely as designed; loose fit substantially increases burn risk. Always check the care label before use.

8. Intellectual Property

All content on the Site — including images, copy, designs, patterns, logos, and the "Happy Skin Baby" name — is owned by us or licensed to us, and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, sell, or create derivative works from any of it without our prior written permission. The Everything Zippy™ and The Mommy Match™ are trademarks of Happy Skin Baby.

9. User Content

If you submit reviews, photos, comments, or other content (collectively, "User Content"), you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute that User Content in connection with our marketing, operations, and the Site. You represent that you own or have the right to share any content you submit, and that it doesn't violate anyone else's rights.

10. Account Security

If you create an account, you're responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at [hello@happyskinbaby.com] if you suspect unauthorized access.

11. Acceptable Use

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to interfere with the Site's operation, security, or other users' access; (c) reverse engineer, scrape, or otherwise extract data from the Site outside of normal browsing; (d) impersonate any person or misrepresent your affiliation with anyone; or (e) use automated tools (bots, scrapers, etc.) without our express written permission.

12. Disclaimers

THE SITE AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. EXCEPT AS REQUIRED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES — EXPRESS OR IMPLIED — INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE OR OUR PRODUCTS IS LIMITED TO THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM. IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.

14. Indemnification

You agree to indemnify, defend, and hold harmless Happy Skin Baby and its officers, employees, and affiliates from any third-party claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your User Content, or your misuse of our products.

15. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

16. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated through the Site or by email when reasonable. Continued use of the Site after changes means you accept the updated Terms.

17. Termination

We may suspend or terminate your access to the Site at our discretion, including if you violate these Terms. Sections that by their nature should survive termination (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will continue to apply.

18. Governing Law & Disputes

These Terms are governed by the laws of the State of North Dakota, without regard to its conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in [Cass county, North Dakota], and you consent to the exclusive jurisdiction of those courts.

19. Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
